Multi-million-dollar settlement ends wrongful death crash lawsuit

Nothing can adequately compensate a San Diego family who loses a loved one in a fatal accident through another's recklessness or negligence. However, a wrongful death lawsuit can seek financial compensation to help assist these families.

A $9.5 million settlement was recently reached in a wrongful death lawsuit for the death of a driver who was killed on July 10, 2014, when a large truck slammed into a car in Santa Clara. The agreement also contains unprecedent terms to deter future unsafe trucking.

A truck was carrying dirt and traveling downhill on Highway 17 when it was unable to stop. It caused a 10-vehicle crash that injured seven other people. The deceased in this lawsuit was killed when he was partially thrown out of his car.

His parents filed this action against the trucking companies in September of 2014. They charged that the defendants took part in negligent hiring, supervision and training and sought stringent truck industry regulations.

The parties agreed to the settlement in August, right before trial and after lengthy pre-trial preparation. The trucking companies' insurers will pay the settlement within 45 days.

The settlement is also unique in that it contains terms reflecting the plaintiffs' allegations that there should be more safety regulation of trucking. It contains a court order that these defendants must comply with safety laws or face significant fines and incarceration. The plaintiffs also insisted on public disclosure of the agreement to deter other trucking companies from violating safety regulations and inspections.

This case is especially tragic for the plaintiffs. Their other son was killed in a car accident on Interstate 5 in 2008.
