Driver in fatal accident facing criminal trial

Any accident can alter many lives, but those that involve the death of a loved one can cause incredible pain. Sadly, the sudden reality is something a number of families faced following a fatal accident in October that was recently back in the news as a criminal case proceeded against the driver involved.

The driver will face trail on counts of gross vehicular manslaughter and DUI stemming from the accident. According to reports, the 25-year-old man was attempting to pass another vehicle while on a transition ramp, but lost control, struck a guardrail before going over the opposite guard rail and down into a park. His vehicle landed on a kiosk where 4 people were hit. Sadly, all four died as a result of the accident.

Aside from the maneuver that began the accident sequence, there are questions regarding other factors in the crash. Police allege that the driver was speeding at the time, and that he was legally intoxicated. The man initially blew two tests below the limit, but an expert suggested that the time delay between the accident and test means that the man was actually over the limit. Police and at least one bystander say that the driver appeared to be disoriented after the crash with red eyes.

While the case progresses in the criminal court, the families of the deceased will be faced with many challenges. Those left to pick up the pieces following a fatal car accident will not only suffer emotionally, but may also face financial challenges from any medical care that was received, lost wages and more. While a criminal case does not directly address these loses, a civil wrongful death case may be pursued against a negligent driver to obtain compensation that will help ease the financial burdens. As the legal standard is lower than in a criminal court of law, a conviction can provide ample support for a successful civil suit.
