Driver falls asleep and causes pedestrian accident in California

When a driver falls asleep at the wheel, it can endanger not only other motorists on the road but those walking along the road as well. An older man lost his dog and nearly lost his life after a vehicle left the roadway and struck them both. The pedestrian accident happened in California in the morning. The California Highway Patrol did say the driver passed tests to see if he was under the influence; however, the driver did apparently provide some insight as to what may have caused this tragedy.

The 60-year-old man was walking his dog along the top of the ramp of the roadway when a car came along and hit him and his dog. The dog became pinned under the vehicle, and that pet died. The pedestrian was rushed to a medical facility nearby for treatment of major injuries.

Police at the scene said the driver admitted to them that he had fallen asleep behind the wheel. He had just gotten off work from his job and says the impact of hitting the pedestrian woke him up. It was not reported whether that driver suffered any injuries.

Even though the driver reportedly passed tests given to see if he was under the influence, he may still face consequences for falling asleep and hitting the man. The victim of this pedestrian accident may be able to pursue civil action in a California court. The result of any civil action taken may include a monetary award that would compensate the man for the financial toll such an accident may have caused, including medical bills, lost wages and pain and suffering.
