When a bike accident occurs, bicyclists have rights

When a bike accident does happen, a bicyclist may benefit by gaining an understanding of his or her rights. One important question is what kind of compensation will ensure that injuries are handled properly. In California, there are several very common situations that can lead to a bike accident and may be grounds for personal injury case in a civil court. If fault on the part of the driver of a motor vehicle can be established, that bicyclist may be able to garner monetary compensation in a civil court.

Crosswalks are often the scene of accidents. One major reason is distracted driving. Texting while driving is a very real source of distraction and, sadly, a cause of many bike accidents.

Other driving behaviors that can lead to an accident can be attributed to driver recklessness or negligence. If the driver who hit a bicyclist was under the influence of drugs or alcohol, that can certainly be a factor used to pursue a civil case. Drivers not obeying the rules of the road, such as stop signs or stop lights, are typically found to have been negligent.

A bike accident victim can be left with medical bills, lost wages and other expenses related to the injuries incurred. Some of those injuries may even require on-going care that is yet to be determined. A civil case in a California court could lead to compensation that can alleviate the strain of being the victim of a bike accident. Our firm has more information regarding bike accidents and the rights of a bicyclist that may have suffered injuries due to the negligence of another.
