No charges filed in San Diego motorcycle accident

Police have decided not to file any charges against the driver of a pickup truck who struck a motorcyclist in San Diego this week. The motorcyclist suffered from serious injuries as a result of the crash and was taken to a nearby hospital. Reports indicate that he is being treated for a broken femur and pain in his neck.

As many San Diego drivers know, it can be hard to predict the movements of a motorcycle in face-paced traffic. All drivers have an obligation to maintain a save speed and to exercise a reasonable amount of caution, which includes following traffic laws and using signals properly. In this case it is not clear if either of the drivers involved violated traffic laws or acted negligently, and the decision by police not to charge anyone with a crime does not necessarily prove that no one was at fault.

The accident occurred in the evening when the motorcyclist was traveling westbound and the southbound pickup trick crossed an intersection in front of him, possibly cutting him off causing the motorcyclist to crash into him. The pickup truck was driven by a 75-year-old man, and it is not clear at this time whether he saw the motorcyclist approaching him or not or if he has had any history of difficulty driving.

Motorcyclists who are injured by negligent, distracted, or otherwise impaired drivers are able to seek compensation for the damage caused to them and their bike, which often includes compensation for medical expenses and property damage.
