Car accident fatalities lead to wrongful death suit

| Nov 1, 2011 | Wrongful Death |

After three of his family members were killed in a massive truck accident, a man is seeking damages from the trucking company that employed the driver who caused the crash. According to the plaintiff’s wrongful death lawsuit, the company is responsible for the truck driver’s negligent actions. Because those actions resulted in the fatal crash, the company is also responsible for the fatalities.

The truck accident occurred in September as three family members were traveling to San Diego from Pittsburg, Texas. While the family was driving through Arizona on I-10, an 18-wheeler crossed the median and crashed head-on into their vehicle. The truck then crashed into another car and a semi truck before rolling onto its side.

Upon impact, the family’s minivan burst into flames. All three people were trapped inside and essentially burned alive, according to the lawsuit. The truck driver was also killed in the crash. Police investigators do not yet know why the truck crossed the median.

Now, the sole surviving immediate family member has filed a wrongful death suit against the trucking company. He is seeking damages for loss of consortium, funeral expenses, medical expenses, mental anguish, loss of services, and several additional causes of action.

If you lost a family member as the result of someone else’s negligence, you may have a legal claim for compensation in a wrongful death claim. You will likely be required to show that you received financial support from the person who was killed in the fatal crash. An experienced personal injury attorney can help you determine whether filing a wrongful death claim would be in your best interest.
