Pedestrians struck in separate incidents minutes and miles apart

It is always difficult to hear and grasp the extreme sorrow and distress of a horrific accident, but it may be even more difficult to process when the accident occurs over the holidays. For an unusual sort of accident to happen twice in one night, to two separate people, within minutes and miles of each other is beyond senseless. Yet, that is just what happened this December on a stretch of East and West Vista Way, only 4 miles and six minutes apart. Both victims were taken to the same hospital. The coincidence itself seems to merit investigation as to causation.

Many factors can contribute to a pedestrian accident, but unfortunately, police and insurance companies too often push fault onto the victims. Were the weather conditions bad? Were the roads properly lit? Were traffic signs functioning properly?

Another range of questions would find fault with the driver of the vehicle involved. Was the driver texting or using a phone? Was the driver fatigued? Was the driver eating? Any of these questions, when affirmed, point to distracted driving as a cause. This is negligence on the part of the driver.

If you or a loved one have been the victim of a pedestrian accident, you may benefit from a California personal injury attorney who knows what to look out for and can counter argue claims that you were at fault. Even if you were partially responsible for how the accident occurred, a lawyer may be able to ensure you are fully compensated for your suffering.
