Police: Young driver on drugs in fatal San Diego crash

A family is grieving after a fatal head-on collision just north of San Diego. According the California Highway Patrol, a young man who graduated from Poway High School was heading west on State Route 56 toward Black Mountain Road when an SUV began to drift leftward toward the center median.

Investigators say the SUV crossed into the oncoming lane and collided head-on with the car, killing the 22-year-old car driver and seriously injuring the 18-year-old behind the wheel of the wrong-way vehicle.

The highway patrol suspected the SUV driver of being on drugs at the time of the crash, and he was arrested and then released to be treated for serious injuries. Police have now confirmed that the wrong-way driver was jailed and charged with DUI causing injury or death, as well as vehicular manslaughter.

At the time of a local report, police had declined to say what sort of drug the 18-year-old is believed to have taken.

The family of the deceased young man are undoubtedly reeling with grief and looking for answers.

Injurious negligence takes many forms, and driving while under the influence is one of them. In cases in which a negligent driver is facing criminal charges, a conviction isn't necessary for the family of the victim to begin building a civil case against the driver. It is possible to see justice done in civil court as well as criminal court.

Even in crashes in which it would seem obvious who was at fault, negligent parties and insurance companies will do their best to shirk responsibility. Nevertheless, the families of victims have recourse to the law.
