Wrongful death suit filed in fatal San Diego crash (2)

Earlier this week, we wrote about a series of personal injury lawsuits that are currently pending in San Diego Superior Court regarding a fatal accident that killed three teens and seriously injured another last spring. It is likely that more legal claims will be made by the families of the other victims in the coming weeks.

Thus far, the parents of a 16-year-old girl who was killed in the crash have filed a wrongful death lawsuit against the driver and his parents, who, the deceased girl's parents argue, are responsible for their son's reckless actions and, therefore, are responsible for the fatalities that resulted. In addition, a personal injury lawsuit has been filed on behalf of another passenger in the vehicle at the time of the accident, who suffered serious injuries and was in a coma for several days after the crash.

Two other teens, ages 17 and 18, were also killed in the accident.

After the fatal crash, the teenage driver pleaded guilty to juvenile charges of gross vehicular manslaughter. He was sentenced to probation and ordered to spend one year at a youth camp.

Both lawsuits also name the driver of the car against whom the teen was racing when he crashed. After the accident, he pleaded guilty to a felony count of engaging in a speed contest in adult court and was sentenced to 180 days in jail. However, he has denied any responsibility for the accident or its fatalities, arguing that his vehicle was not the one that crashed.

This is a tragic situation for all involved. Hopefully, the lawsuits will be resolved quickly and fairly.
