California city settles dog bite lawsuit

A California city has reached a settlement with a 7-year-old boy and his family in regard to a dog bite that took place at a city park and that left the boy with serious, lasting injuries. Under the terms of the settlement, the city will pay more than $300,000 to the family, to be used for past and future medical bills, therapy, education and other costs.

According to court records, the dog bite incident took place on a Sunday afternoon in October 2010 when a man was playing with his two dogs in a dog run at the city park. One of the dogs, a pit bull, escaped from the run by pushing through an unsecured service gate at the opposite end of the park from where his owner was standing. The dog charged onto a nearby ballfield, where the boy was playing with his parents, and attacked the boy, causing him to suffer neck, back and shoulder injuries and brain damage.

The family sued the city for nearly $1 million, citing the city's failure to properly secure the dog run service gate as the reason for the attack. Not wanting to go to trial, the city settled with the family for $325,000. The settlement must still be approved by a judge.

Following the attack, the dog was quarantined for 10 days to ensure that he did not have rabies. He and his owner then left the state. It is unknown whether the owner was also named in the personal injury lawsuit.
