Fatal accident kills parents, brother of newborn

Although this accident did not take place in California, our San Diego readers may well be saddened and shocked to hear of a grievous motor vehicle accident that happened in late February. A family of four, returning home from the hospital with a newborn baby boy, was hit head-on by a driver who had crossed lanes into oncoming traffic. Tragically, the fatal accident left three of the four dead with the 2-day-old newborn as the sole survivor of the crash.

The accident reportedly happened as family of four, including a 3-year-old boy, was traveling westbound on a Missouri highway. Suddenly, the other driver, who had been traveling eastbound, crossed the center line. The resulting head-on collision killed the 36-year-old father and 27-year-old mother, both of whom pronounced dead at the scene of the accident. The 3-year-old boy was taken to a nearby hospital, where authorities pronounced him dead shortly thereafter.

In an accident of this type, all one can hope for is that the newborn, who received only moderate injuries, is able to grow up healthy and well. He has reportedly been placed in the care of relatives. At this time, authorities do not know what caused the 19-year-old driver of the other car to cross lanes. She is currently in intensive care, and officials believe that it will take several weeks to do a reconstruction of the accident.

As they mourn for their loss, the relatives may consider the possibility of filing a civil claim for damages against the driver on behalf of the baby boy as well as wrongful death claims on behalf of the deceased victims. Doing so may bring some manner of closure by holding her accountable for any negligent actions in the fatal accident. It may also help the relatives with their funeral and medical expenses, while also helping to provide monetary compensation for the newborn.
